This discussion had place also in the Italian mailing list of sysops.

There was a clear statement of the Minister of Cultural Heritage to 
answer to a question of a member of the Parliament. In Italy there is no 
law stating that there is the "freedom of panorama" BUT there no law 
stating that there is NOT the "freedom of panorama".

Mainly the Minister said that there is a the freedom of panorama because 
no law imposes something different BUT the copyright protect the 
architecture, so the freedom of panorama may not be applied to the 
recent buildings.

I know that the Italian team organizing WLM had a long discussion with 
lawyers in order to understand what was allowed to be photographed. They 
can answer better than me.
